That's what I'm saying they won't replace "out of warranty" so gesture of good will is worth a try but I highly doubt BMW will approve given the cost of the item. Plus it opens the flood gates for eveyone else who may be in the same boat. Do it for one do it for all

That is a design/manufacturing defect and in no way can be considered normal wear and tear, if they donít play ball and do the decent thing I would threaten them with trading standards,

Ime not too sure about that Melv, the trouble with welding Titanium is it has to be scrupulously clean and needs a back purge of argon to get a perfect weld, not easy in situ.

Is that pipe going into the muffler stainless or titanium Fred, I noticed the pipe going into mine is titanium, not dpsure if I have the new design one they were going to release in June

No idea Melv but we have been joining titanium to stainless and titanium to titanium for decades without screwing it up the way they have.

This,

Warranty is warranty. If they approve a claim as a gesture of good will for one it opens up the flood gates for eveyone else who had a claim rejected to kick up a stink.

I think BM will be pretty fair about it and acknowledge it's a design fault, weather you can get your dealer, who prob won't give a sh1t to pursue it on your behalf is another matter.
You can then always go to BMUK

Someone on the other thread has just had his replaced with the latest super duper version and there is an extra stiffening bracket.
This proves it is a design fault and the end plate has been flexing hence the bloody big crack as displayed on the OPs pic. I would go back to the dealer and shout DESIGN FAULT they do not have a leg to stand on.
